These Terms of Service ("Terms") govern the use of creative services provided by NOIRIN ("NOIRIN", "I", "me", or "my"). By purchasing a service, submitting a creative brief, or engaging my services, you agree to these Terms.

1. Services

NOIRIN provides professional creative services, including:

AI Film – cinematic AI-generated videos created from concept to final delivery.
Fashion Image Set – editorial-quality AI imagery developed in a cohesive visual style.
Brand Visual Audit – strategic analysis of your visual identity with recommendations for improvement.
Catalog Photography – production-quality AI catalog imagery for fashion and e-commerce brands.

Each project is developed individually and tailored to the Client's brand, objectives, and approved creative direction.

2. Creative Process

Every collaboration begins with a creative brief.

Before production starts, the following elements are discussed and approved by the Client:

Creative concept
Visual references
Art direction
Mood and aesthetic
Color palette
Brand requirements

Once approved, these elements become the creative foundation of the project.

3. AI Production

All images and videos are created from scratch using artificial intelligence.

NOIRIN does not edit stock footage or existing photographs. Every visual is uniquely generated for each Client based on the approved creative direction.

Due to the nature of AI-generated content, every image and video is an original creation and may contain minor variations that are part of the creative process.

4. Delivery Time

Most individual projects are delivered within 4 business days after the creative brief has been approved.

Larger projects or multiple-service bookings are scheduled individually according to the project's scope.

Delivery times may be extended if the Client delays approvals, feedback, or the submission of required materials.

5. Revisions

Each AI image or AI video project includes one complimentary revision, provided the requested changes remain within the approved creative brief.

Additional revisions requiring new AI generation are billed separately.

Replacement or regeneration of individual images or scenes starts from €10 per item.

Requests that change the approved concept, references, creative direction, or overall visual style are considered a new scope of work and will be quoted separately.

6. Payment

All projects require 100% advance payment before production begins unless otherwise agreed in writing.

All prices are listed and payable in EUR (€).

Production begins only after payment has been received.

7. Client Responsibilities

The Client agrees to:

provide accurate project information;
supply references when applicable;
review and approve the creative concept before production begins;
provide timely feedback throughout the project.

Approval of the creative brief, references, and visual direction confirms that the Client accepts the creative direction of the project.

8. Intellectual Property

Upon full payment, the Client receives commercial usage rights to the final approved deliverables unless otherwise agreed in writing.

NOIRIN retains the right to display completed work in its portfolio, website, social media, presentations, and promotional materials unless the Client requests confidentiality in writing before the project begins.

9. Refund Policy

Because every project is custom-created specifically for the Client, all payments are non-refundable once production has begun.

10. Limitation of Liability

NOIRIN delivers all work in accordance with the approved creative brief, references, and creative direction.

Once the Client has approved the creative concept, references, mood board, and visual direction, NOIRIN shall not be responsible for subjective dissatisfaction with the final result if the delivered work substantially reflects the approved materials.

Creative services involve artistic interpretation, and AI-generated content may naturally vary in details while remaining faithful to the approved concept.

NOIRIN cannot guarantee commercial results, including increased sales, engagement, audience growth, or business performance resulting from the use of the delivered materials.

11. Right to Decline Projects

NOIRIN reserves the right to decline or discontinue any project that:

conflicts with applicable laws;
infringes intellectual property rights;
promotes hate, discrimination, violence, or illegal activity;
conflicts with NOIRIN's professional or ethical standards.

If production has not yet started, any payment received will be refunded.

12. Force Majeure

NOIRIN shall not be liable for delays or failure to perform caused by events beyond reasonable control, including but not limited to internet outages, AI platform failures, technical disruptions, natural disasters, governmental actions, or other force majeure events.

13. Acceptance of These Terms

By making payment, submitting a creative brief, providing project materials, or otherwise engaging NOIRIN's services, the Client confirms that they have read, understood, and accepted these Terms of Service in full.
